Terms of Service

These Terms of Service ("Terms") govern your use of applications and services created by CyborgDev ("we", "our", or "us"), including Smoothie Lab and any other CyborgDev products. By downloading or using our applications, you agree to these Terms.

1. Acceptance of Terms

By accessing or using any CyborgDev application, you confirm that you are at least 13 years old (or 16 in the EEA), that you have read and agree to these Terms, and that you have the legal capacity to enter into this agreement.

2. Our Services

CyborgDev provides AI-powered mobile applications. Features vary by application and subscription tier. We reserve the right to modify, suspend, or discontinue any feature or service at any time with reasonable notice.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate information when creating an account.
• You may not share your account with others or use another person's account.

4. Subscriptions & Payments

Some CyborgDev applications offer paid subscription tiers. By subscribing:

• You authorize the applicable app store (Apple App Store or Google Play) to charge the subscription fee to your payment method on a recurring basis.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Prices are subject to change with advance notice.
• You can manage and cancel subscriptions through your Apple ID or Google account settings.

5. Refund Policy

All purchases are processed through Apple App Store or Google Play. Refund requests are handled according to their respective refund policies. CyborgDev does not process refunds directly. To request a refund, visit:

6. Acceptable Use

You agree not to:

• Use our applications for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or disassemble any part of our applications.
• Use automated tools to scrape, crawl, or extract data from our services.
• Upload content that is harmful, offensive, or infringes on others' rights.
• Interfere with or disrupt the integrity or performance of our services.

7. Intellectual Property

All content, features, and functionality of CyborgDev applications — including but not limited to text, graphics, logos, and code — are owned by CyborgDev and protected by applicable intellectual property laws. You may not reproduce or distribute any part of our applications without express written permission.

8. AI-Generated Content

Some features of our applications use artificial intelligence to generate content (e.g., recipe suggestions). AI-generated content is provided for informational purposes only and does not constitute professional medical, nutritional, or health advice. Always consult a qualified professional before making significant changes to your diet or health routine.

9. Health Disclaimer

CyborgDev applications that incorporate health or fitness features are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease or health condition. Use these features as a wellness tool only.

10. Disclaimer of Warranties

Our applications are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the maximum extent permitted by law, CyborgDev shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, our applications. Our total liability for any claim shall not exceed the amount you paid to us in the twelve months preceding the claim.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Connecticut, United States, without regard to its conflict of law provisions.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via in-app notice or email. Continued use of our applications after changes take effect constitutes your acceptance of the updated Terms.
